Terms of Service
Last updated: October 29, 2026
These Terms of Service (“Terms”) govern your access to and use of the Offstream mobile applications, website, and related services (collectively, the “Service”) provided by Offstream LLC, a Wyoming limited liability company, 30 N Gould St, Ste R, Sheridan, WY 82801, USA (“Offstream,” “offstream.gg,” “we,” “us,” or “our”).
By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. What offstream.gg is
offstream.gg lets fans (“Fans”) book paid online gaming sessions (“Sessions”) with streamers who have verified a streaming account (“Streamers”). Offstream is only a booking and payments platform. It facilitates the connection, the booking, and the payment. Offstream is not a party to the Session or to any agreement between a Fan and a Streamer. Sessions are provided by Streamers, not by Offstream, and they take place outside the Service (for example on a game platform or another service you choose). You are responsible for your own interactions with other users and for your safety during a Session.
Offstream is not affiliated with, endorsed by, sponsored by, or partnered with Twitch Interactive, Inc., Amazon.com, Inc., or Stripe.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you are at least 18 and have the legal capacity to agree to these Terms. We may ask for your date of birth to confirm that. The Service is not available to anyone Offstream has removed or banned.
3. Accounts
- You sign in with Twitch or with email and a password. Streamers sign in with an account they control and connect a Twitch account they control. Keep your sign-in methods secure. You are responsible for activity on your account. Tell us at support@offstream.gg if you think someone else is using it.
- Give us accurate information and keep it up to date. We may suspend or close an account that gives false information or breaks these Terms.
- One person, one account. Creating accounts to get around a ban, a limit, or a review is not allowed.
4. Streamers
Streamers are independent contractors. They are not employees, partners, or agents of Offstream. A Streamer is responsible for their own taxes on amounts they receive.
Streamer accounts are available only to people who live in the United States or Canada. You choose that country when you sign up as a Streamer. We store it on your profile and use it to open your Stripe payout account. It can’t be changed in the app. A different country needs a new Stripe account. Contact support if you need that.
To receive payouts, you agree to the Stripe Connected Account Agreement and the Stripe Services Agreement, as Stripe may update them. You authorize Offstream to share information with Stripe as needed to provide payment services. Stripe is needed to withdraw earnings, not to accept a booking. Once your Streamer account is approved, including instant approval, you can accept bookings right away. Earnings can accumulate until you set up payouts.
Streamers verify by connecting a Twitch account. Channels that meet our published thresholds are approved automatically; others are reviewed manually. Your offstream.gg link is offstream.gg/ followed by your Twitch channel name.
5. Usernames and impersonation
(a) Assigned usernames. You sign in with Twitch or with email and a password. Each new account gets a randomly generated username, which is replaced by your Twitch channel name if you connect Twitch.
(b) Usernames aren't property. Usernames are licensed to you, not owned by you. offstream.gg may reclaim, reassign, or require you to change any username, including (i) to prevent or stop impersonation, (ii) to give a name to the verified owner of a matching streaming channel, (iii) when the linked channel is renamed, (iv) for reserved, offensive, or misleading words, or (v) to comply with law, a trademark claim, or these Terms. Where practical, we'll give you notice before making the change.
(c) Channel names. A username that matches a Twitch channel name may be held only by the verified owner of that channel. Verification currently works through Twitch, and offstream.gg may add other platforms later. If a verified owner renames their Twitch channel, their old offstream.gg username may be released after 14 days.
(d) No impersonation. You may not pretend to be any person, streamer, brand, or offstream.gg staff member, or falsely suggest you're affiliated with one, through your username, display name, avatar, profile, or messages. Offstream LLC may remove content, change usernames, and suspend or terminate accounts that violate this rule. Report impersonation at support@offstream.gg.
(e) A username change doesn't affect your existing bookings, payments, or obligations.
6. Prices, fees, and payment
- Streamers set package prices (minimum $5.00). Fans pay the package price plus a service fee shown at checkout (currently 7.9% of the price plus $0.47, rounded down to the cent). The same service fee applies to tips.
- offstream.gg's platform fee is deducted from the Streamer's earnings for each Session (currently 10% of the package price plus $0.50, rounded down to the cent, and never below $0.00; a different percentage may be agreed for an individual Streamer). Streamers receive 100% of the tip amount. Refunds are split in the same proportion as the original charge.
- Tips are not refundable once they have been processed.
- Payments are processed by Stripe. When you pay, we save your card with Stripe for your next booking or tip on offstream.gg. You can pay with that saved card or enter a different one. We don't store your full card number. All amounts are in United States dollars. Any currency conversion, bank fee, or additional Stripe fee is your responsibility. When you book, your card is authorized (a hold). It is charged (captured) when the Session completes: 72 hours after the Streamer accepts, or earlier when you confirm the Session. A review or a tip also confirms it. If you report a problem first, the charge is paused until we review it. After acceptance, both sides see a countdown to that automatic completion on the order, in the chat, and in the bookings list. Play your Session before the timer ends; if something went wrong, report a problem before it hits zero.
- If the Streamer declines or does not accept within 24 hours, the hold is released and you are not charged. An approved Streamer, including one approved instantly, can accept the booking before Stripe payouts are set up. Stripe is required to withdraw, not to accept. If they don't accept in time, the hold is released the same way and you are not charged. Some orders are reviewed before they reach the Streamer. The 24 hours then start once the order is sent to the Streamer, and if that review is not finished in time the hold is released and you are not charged.
- Your order shows a 4-digit PIN. Share it with the Streamer when you are ready to play. The Streamer accepts by entering your PIN. There is no acceptance without it, and too many wrong PINs lock acceptance pending our review. Your payment locks in at acceptance and the hold stays in place until capture.
- After acceptance, the Streamer may mark the Session complete at any time. Marking it complete does not charge the card and does not change the 72-hour countdown. It asks the Fan to confirm. The Fan can confirm with or without a star rating, a comment, or a tip. Confirm charges the card. Report a problem instead and the charge pauses for review. If the Fan does neither, the Session still completes 72 hours after acceptance. The Streamer can undo the mark until the Fan confirms. A comment left on confirm is private. Earnings still become available 7 days after capture, not when the Session is marked complete.
7. Cancellations and refunds
- Before the Streamer accepts: cancel for free; the hold is released.
- After acceptance: ask the Streamer in chat to cancel (a Streamer cancel is never charged), or use “Report a problem”.
- If something went wrong, use “Report a problem” on the booking before the Session completes. The charge is paused while we review, and we may refund in full or in part.
The cancellation policy is shown at checkout and you must acknowledge it to book.
Offstream may cancel a booking, issue a refund, reverse a transfer, or hold funds where we believe there has been fraud, a material failure to perform, a violation of these Terms, a chargeback, or other misuse, including after the usual completion window.
8. Chargebacks
Contact support@offstream.gg and give us a reasonable chance to resolve the issue before you start a chargeback. A chargeback that is abusive or fraudulent is a material breach of these Terms. Tips are not refundable once they have been processed.
9. Chat
Each Fan and Streamer pair has one conversation. Messages can be sent only while you have an active booking together; otherwise the conversation is read-only. Messages are stored with the booking they relate to. Offstream may review messages when looking into a dispute, a safety issue, fraud, a chargeback, or a violation of these Terms.
10. Streamer payouts
- Streamers receive the package price for completed Sessions, less the platform fee described above, plus 100% of tips. Earnings become available 7 days after capture and can be withdrawn to a connected Stripe account once the available balance is at least $20.00. Payout setup is not required before a Streamer can accept a booking. Once approved, including instant approval, a Streamer can accept bookings immediately. Earnings accumulate until payout setup. Stripe is required to withdraw, not to accept.
- Charges and transfers stay in US dollars. A Canadian bank payout is typically in Canadian dollars; Stripe converts when it pays that bank. The payout country is the one saved at signup and can't be changed in the app.
- Earnings tied to orders under review may be held until the review is complete.
- If a payment is disputed (chargeback), related payouts may be paused. offstream.gg pays the card network's dispute fee. If a dispute is lost and we determine the Streamer was at fault (for example, a no-show or fraud), the disputed earnings are deducted from the Streamer's balance, including future earnings.
- If a refund or dispute happens after a withdrawal, the amount is recovered from the Streamer's balance, including future earnings. Available earnings can go below $0.00 until later sessions cover it.
11. Your content
You keep ownership of content you submit, including messages, reviews, feedback, and profile information. By submitting content, you grant Offstream a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, store, display, reproduce, modify, and distribute that content as needed to operate, secure, and improve the Service, including to investigate reports and disputes. You represent that you have the rights to grant this license and that your content does not violate any law or anyone else's rights. We may remove any content.
12. Acceptable use
You agree not to:
- Harass, stalk, threaten, or harm any other user.
- Use fraud, stolen or unauthorized payment methods, self-dealing (booking yourself), money laundering, or attempts to manipulate payouts.
- Post hate, sexual content involving minors, threats, or illegal activity in Sessions or chat.
- Take payments for Sessions outside offstream.gg after meeting through the Service, or otherwise circumvent the Service or its fees.
- Impersonate any person or entity, scrape or interfere with the Service, upload malicious code, or collect other users' personal information without consent.
- Use the Service for any illegal purpose, or violate any applicable law.
13. Platform rights
Offstream may, at any time:
- Refuse, cancel, or modify any booking.
- Hold, reverse, or refund funds.
- Remove content.
- Suspend or permanently ban any user, and block payment methods or linked platform accounts that violate these Terms.
- Modify or discontinue any part of the Service.
Offstream may access, review, and use messages and other communications between users when investigating reports, disputes, suspected fraud, safety concerns, chargebacks, or violations of these Terms. We have no obligation to monitor disputes between users, but we may do so.
14. Intellectual property
The Service, including its design, features, text, graphics, and software, is owned by Offstream LLC and its licensors. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written permission.
15. Third-party services
The Service connects to Twitch and Stripe, and to other providers that host the Service, deliver email, and send notifications. Your use of Twitch and Stripe is subject to their own terms and privacy policies. Offstream is not responsible for third-party services.
16. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE THE SERVICE AT YOUR OWN RISK. OFFSTREAM DOES NOT GUARANTEE ANY STREAMER’S SKILL, AVAILABILITY, CONDUCT, OR THE OUTCOME OF ANY GAME, AND IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY FAN OR STREAMER OR FOR ANYTHING THAT OCCURS DURING A SESSION OUTSIDE THE SERVICE.
17. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OFFSTREAM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO OFFSTREAM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
18. Indemnification
You agree to defend, indemnify, and hold harmless Offstream LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your content; (c) your violation of these Terms; (d) your violation of any law or third-party rights; or (e) your interactions with other users.
19. Release between users
Disputes between a Fan and a Streamer are between those users. To the maximum extent permitted by law, you release Offstream and the other user from claims, demands, and damages of every kind, known or unknown, arising out of your interactions, a Session, or a dispute with another user. If you are a California resident, you waive California Civil Code Section 1542, which says that a general release does not extend to claims the releasing party does not know or suspect to exist at the time of the release and that, if known, would have materially affected the settlement.
20. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including a violation of these Terms. You can delete your account at any time in Settings. See the Privacy Policy for the 30-day grace period for adults and what we must keep. When access ends, your right to use the Service ends. Sections that by their nature should survive, including intellectual property, disclaimers, limitation of liability, indemnification, release, and dispute resolution, will survive.
21. Dispute resolution
Informal resolution. Before starting arbitration or a lawsuit, you agree to email support@offstream.gg and try to resolve the dispute informally. We will try to resolve it within sixty (60) days.
Binding arbitration. If we cannot resolve the dispute within sixty (60) days, any remaining dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules and, where they apply, its Mass Arbitration Supplementary Rules. The Federal Arbitration Act governs this arbitration agreement. The arbitration will be seated in Wyoming or conducted remotely. Each party pays fees according to the AAA rules.
Small claims. Either party may bring an individual claim in small claims court instead of arbitration if the claim qualifies and stays in that court.
YOU AND OFFSTREAM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. YOU AND OFFSTREAM ALSO WAIVE ANY RIGHT TO A JURY TRIAL.
Intellectual property. Either party may go to court to seek injunctive or other equitable relief to stop actual or threatened infringement, misappropriation, or violation of intellectual property or data-security rights.
Opt out. You may opt out of this arbitration agreement by emailing support@offstream.gg within 30 days after you create your account. The email must come from the address on the account, include your username, and state that you opt out of arbitration. Opting out does not affect the rest of these Terms. If you opt out, either party may bring an individual claim in court as described under Governing law.
If the class-action waiver is found unenforceable, this arbitration agreement is void in its entirety. The rest of these Terms still apply.
22. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules, except where the law of your place of residence requires otherwise. Subject to the dispute resolution section, courts in Wyoming have exclusive jurisdiction over matters that are not arbitrated, except for a small-claims case, a claim for injunctive relief to protect intellectual property or data security, or where the law of your place of residence requires a different court.
23. Changes to these Terms
We may update these Terms. For a material change, we will announce it in the app or by email before it takes effect, and we will post the updated Terms and change the “Last updated” date. If you keep using the Service after the effective date, you accept the updated Terms.
24. General
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and Offstream about the Service.
Severability. If any provision is unenforceable, the rest remain in effect, except as stated in Dispute resolution if the class-action waiver is unenforceable.
No waiver. If we do not enforce a right, that is not a waiver of that right.
Assignment. You may not assign these Terms. We may assign them.
Force majeure. Offstream is not liable for a failure or delay caused by events beyond its reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of government, fire, flood, accident, pandemic, strike, shortage of transportation, facilities, fuel, energy, labor, or materials, or a failure of a third-party provider or of internet infrastructure.
Limitation of claims. Any claim arising out of or related to these Terms or the Service must be filed within one (1) year after the claim arose, or it is permanently barred, except where a longer period is required by law.
